This Agreement is a binding contract between you and OGOFX. When you register in the client portal you accept the Client Agreement, the Terms of Business and the Regulations for Non-Trading Operations, and you confirm that you have read the Risk Disclosure, the Privacy Policy and the Cookie Policy.
Risk warning. CFDs are complex instruments and come with a high risk of losing money rapidly due to leverage. Consider whether you understand how CFDs work and whether you can afford to take the high risk of losing your money.
1. Parties and scope
1.1 This Client Agreement (the "Agreement") is made between OGOFX ("OGOFX", "we", "us", "our") and the person who registers in the OGOFX client portal and accepts it ("you", "your", the "Client").
1.2 OGOFX operates under local licence no. 8256953 and is licensed on the OGO platform. We make no other statement about regulation, and nothing in this Agreement should be read as one.
1.3 This Agreement governs every trading account you open with us, every order you place, every deposit and withdrawal you make, and your use of the client portal at portal.ogofx.com and the OGOFX web terminal.
1.4 When you register in the client portal you accept the Client Agreement, the Terms of Business and the Regulations for Non-Trading Operations, and you confirm that you have read the Risk Disclosure, the Privacy Policy and the Cookie Policy. These documents should be read with this Agreement:
- Terms of Business, which set out how orders are handled and how charges apply;
- Regulations for Non-Trading Operations, which set out how deposits, transfers and withdrawals work;
- Risk Disclosure, which explains the risks of trading contracts for difference;
- Privacy Policy and Cookie Policy, which explain how we handle your personal data and the cookies the client portal uses.
1.5 Words with capital letters have the meanings given in section 20 (Definitions).
2. Nature of the service
2.1 We offer contracts for difference ("CFDs") on currency pairs, metals, stock indices and energy. We currently offer 51 instruments: 32 currency pairs, 5 metals, 11 indices and 3 energy markets. The current list, with the contract specification of each instrument, is published on our contract specifications page.
2.2 A CFD is an agreement to exchange the difference in the price of an underlying asset between the time a position is opened and the time it is closed. You do not own, buy, sell or take delivery of the underlying asset at any time.
2.3 We provide an execution-only service. We do not give investment, tax or legal advice, and we do not recommend any transaction. Market information, prices, charts and studies in the web terminal are provided for information only. Every decision to open, keep or close a position is yours.
2.4 CFDs are leveraged products. Open an account only if you can afford to lose the money you deposit, and read the Risk Disclosure before you trade.
3. Eligibility
3.1 You may open an account only if you are of full legal age and have full legal capacity to enter into this Agreement in your country of residence, and only if offering our services to you is lawful there.
3.2 We do not provide services to residents of the United States. You may not register, open an account or trade with us if you are resident in the United States.
3.3 You must act on your own behalf. An account may not be opened or operated for another person, and you may not let another person use your login details or trade on your accounts.
3.4 We may decline any application, or close any account under section 16, without giving a reason where the law allows us to do so.
4. Registration and verification
4.1 Registration. To register you give your name, email address, mobile number with country code and country of residence, choose a password of at least 10 characters containing letters and numbers, accept this Agreement, the Terms of Business and the Regulations for Non-Trading Operations, and confirm that you have read the Risk Disclosure, the Privacy Policy and the Cookie Policy. You then confirm your email address through the link we send to it.
4.2 Accurate information. All information you give us must be true, complete and current. You must tell us promptly, through the client portal or by email to support@ogofx.com, if any of it changes.
4.3 Verification before money moves. You must complete identity verification before you can make a deposit or a withdrawal. You upload, in the client portal:
- a photo identity document: a passport, a national identity card or a driving licence; and
- a proof of address.
4.4 Documents may be uploaded as JPEG, PNG, WebP or PDF files of up to 10 MB each. Each submission is reviewed by a person on our team. Questions about verification can be sent to verification@ogofx.com.
4.5 We may ask for further documents or information at any time, including when the documents you gave expire, when your details change, or when we need to meet our legal obligations. Until we receive what we have asked for, we may restrict deposits, withdrawals or trading on your accounts.
4.6 We may reject a document that is unclear, incomplete, expired, altered or does not match the details you registered with.
5. Trading accounts
5.1 Account types. We offer three trading account types: Standard, Raw and Pro. Every account type trades the same instruments in the same web terminal; they differ in how you pay to trade, in the minimum first deposit and in the maximum leverage.
| Standard | Raw | Pro | |
|---|---|---|---|
| Pricing | No commission; markup in the spread | Raw spread plus commission | Raw spread plus commission |
| Spread from (EURUSD) | 0.1 pips | 0.0 pips | 0.0 pips |
| Markup in the spread, currency pairs | $1 a lot | None | None |
| Markup in the spread, metals, indices and energy | 50% | None | None |
| Commission per lot, charged once when the position opens | None | $7 | $5 |
| Swap markup | 50% | 50% | 50% |
| Minimum first deposit | $5 | $5,000 | $20,000 |
| Maximum leverage | 1:500 | 1:500 | 1:200 |
| Margin call level | 100% | 100% | 100% |
| Stop-out level | 50% | 50% | 50% |
| Largest order (per instrument) | 2 lots | 2 lots | 2 lots |
5.2 The figures in the table are read from the platform when this page is published. They can change as set out in section 19, and the terms that apply to your account are shown in the client portal. Margin call and stop out work as set out in section 7.
5.3 Number of accounts. You may hold up to 3 trading accounts.
5.4 Account currency. Every trading account is held in US dollars (USD). Deposits in USDT are credited one to one in USD, and withdrawals are paid in USDT on the same basis.
5.5 First deposit. The first deposit to an account must be at least the minimum first deposit for its account type.
5.6 Security of access. You are responsible for keeping your password, your email account and any authenticator device secret and secure. You may switch on two-factor authentication with an authenticator app (TOTP); if you do, keep your recovery codes in a safe place. We treat every instruction given through your login as given by you, unless you told us beforehand that your login had been compromised.
5.7 If you believe someone else has access to your login, change your password at once and tell us at support@ogofx.com. We may suspend access to your accounts while we look into it.
6. Leverage and margin
6.1 Choosing leverage. You choose the leverage of each account when you open it, from 1:1 up to the maximum for that account type.
6.2 Margin. To open and keep a position you must hold enough margin on the account. The margin for a position is its contract value divided by the leverage that applies.
6.3 Your responsibility. You must watch your margin level at all times. We are not obliged to contact you before a margin call or a stop-out.
6.4 Higher leverage means a smaller price move can wipe out your margin. Leverage magnifies losses as well as gains. Choose a level you understand.
7. Margin call and stop out
7.1 Margin level is your equity divided by the margin used by your open positions, shown as a percentage.
7.2 Margin call. When your margin level falls to the margin call level of your account type (100% on Standard, 100% on Raw and 100% on Pro), the account is in margin call. A margin call is a warning that the account is close to stop out: you should add funds or reduce your positions.
7.3 Stop out. When your margin level falls to the stop-out level of your account type (50% on Standard, 50% on Raw and 50% on Pro), the platform closes open positions automatically at the prices then available, without further notice to you, until the margin level is above the stop-out level or no positions remain.
7.4 In fast or gapping markets, a stop-out can be executed at a price materially worse than the price at which the stop-out level was reached. Any loss that results is yours, subject to section 12 (Negative balance).
8. Orders and execution
8.1 How you place orders. You place orders in the OGOFX web terminal, which runs in your browser on a computer or phone. Orders are accepted only through the web terminal.
8.2 Order types. The web terminal supports market orders, limit orders and stop orders; stop loss and take profit levels on positions and pending orders; one-click trading; and partial closing of positions.
8.3 Execution model. All accounts use market execution. Your orders are routed to our liquidity provider's MetaTrader 5 servers and filled at the price available there when the order is executed.
8.4 Price at execution. The price at which a market order is filled may differ from the price shown when you sent it, in either direction ("slippage"). Pending orders and stop loss orders become market orders when their trigger price is reached and can be filled at a worse price than the trigger, particularly when the market gaps or moves fast.
8.5 Order size. The minimum order size is 0.01 lot, in steps of 0.01 lot, unless the contract specification of an instrument sets a larger minimum or step. A trading account can hold up to 2 lots open in one instrument, so the largest order is 2 lots. The cap applies to each instrument on each account, not to the account’s total open volume. The platform’s per-order limit of 10 lots is higher than this cap, so the cap is the limit that binds.
8.6 Trading hours. You can trade an instrument only during its trading sessions, which are published on our trading hours page in broker server time (UTC+3 at the time of publishing; it moves by an hour with daylight saving). Orders cannot be executed while a market is closed. Pending orders and stop levels may be filled at the first available price when the market reopens.
8.7 Rejected and cancelled orders. An order may be rejected if there is not enough free margin, if it breaks a size limit, if the market is closed, if no price is available, or if the liquidity provider does not accept it. Once an order has been executed it cannot be cancelled.
8.8 Errors. If you believe a trade was executed at a clearly wrong price because of a fault in a price feed or system, tell us at once at support@ogofx.com. We look into it using the records described in section 14.3 and tell you what we find.
8.9 The Terms of Business describe order handling in more detail.
9. Prices and charges
9.1 Prices. We quote a sell (bid) price and a buy (ask) price for each instrument. The spread is the difference between them. Spreads are variable and may widen, sometimes sharply, around news, at market opens and closes, at the daily rollover and in thin markets. A "spread from" figure is the lowest spread an account can show, not a typical spread.
9.2 Our charges. The Standard account has no commission; its markup is in the spread ($1 a lot on currency pairs, 50% of the spread on metals, indices and energy). The Raw and Pro accounts pay the liquidity provider’s raw spread plus commission per lot ($7 on Raw and $5 on Pro), charged once when the position opens; it covers both opening and closing the position. Swap is charged or paid separately on every account type (section 10).
9.3 Our fees page shows the commission of each account type and the current spread and swap rates of every instrument. Spreads move with the market, and swap is charged or paid later, at the rollover.
9.4 Funding charges. We do not charge a fee to deposit. The withdrawal fee is 1 USDT for each withdrawal, as set out in section 11.
9.5 Conversion. Where an instrument’s profit currency is not USD, its profit or loss is converted into USD at the platform’s current rate.
10. Swap (overnight financing)
10.1 A position held open through the broker’s daily rollover, at broker midnight in broker server time, is charged or paid a swap: the financing cost or credit of holding the position overnight.
10.2 Swap rates are set per instrument, separately for long (buy) and short (sell) positions, and may be negative or positive. They are the liquidity provider’s rates with our markup of 50%: a charged swap is made larger by this share, and a paid swap smaller. The rates are the same on every account type and change from time to time with interest rates and market conditions.
10.3 On one night of the week swap counts three nights. Today that night is Wednesday on every instrument. The triple-swap day of each instrument is shown in its contract specification.
10.4 Our fees and contract specifications pages show the swap rates of every instrument in US dollars per lot per night.
11. Deposits and withdrawals
11.1 Method. We accept deposits and pay withdrawals only in USDT on BNB Smart Chain (BEP20). We do not accept any other currency, token or network. Only verified clients can deposit or withdraw (section 4.3).
11.2 Deposits. Each trading account has its own BEP20 USDT deposit address, shown in the client portal. You deposit by sending USDT on BNB Smart Chain (BEP20) to that address. The deposit is credited to that trading account, one to one in USD, after the network confirms the transfer. A deposit above $50 is credited after a check by our team. A deposit smaller than 1 USDT waits on the address and is added to the next one. We do not charge a fee to deposit; the network fee for your transfer is paid by you to the network.
11.3 Wrong transfers. You are responsible for sending the right token on the right network to the right address. A transfer of another token, on another network, or to another address may not be credited and may not be recoverable. We are not liable for funds lost in that way.
11.4 Wallet. You also have a wallet in the client portal. You can move money between your wallet and your trading accounts there.
11.5 Withdrawals. You request a withdrawal in the client portal, from your wallet or from the free margin of a trading account, and give your own BEP20 USDT address. Up to 3 withdrawal requests can wait at once. Every withdrawal is reviewed and sent by our team to that address. The minimum withdrawal is 10 USDT and the withdrawal fee is 1 USDT. There is no daily withdrawal limit.
11.6 You must give an address you control. We are not liable for funds sent to an address you gave us that is wrong or that you do not control. Blockchain transfers cannot be reversed once sent.
11.7 Funds used as margin for open positions cannot be withdrawn. We may delay or decline a withdrawal while verification under section 4 is incomplete, while we review activity under section 13, or where the law requires us to.
11.8 Questions about withdrawals can be sent to withdrawals@ogofx.com. The full rules are in the Regulations for Non-Trading Operations.
12. Negative balance
12.1 Your losses on an account are limited to the funds on that account. If a loss on an account is deeper than its balance, for example because the market gaps through the stop-out level, a loss deeper than the balance is written off; the balance stops at zero.
12.2 We will not ask you to pay a negative balance arising from trading.
13. Prohibited conduct
13.1 You must not, alone or with others:
- exploit errors, delays or faults in our prices, price feeds, platform or systems, including trading on prices you know or ought to know are wrong or stale;
- use any software, script or tool to interfere with, overload, scrape or gain unauthorised access to the web terminal, the client portal or our systems;
- open or run accounts in another person's name, give false information, or use accounts held by different people in a co-ordinated way to gain an advantage that one account could not;
- engage in market abuse, manipulation, or any activity that is fraudulent or unlawful;
- use your account to deposit, hold or move money that comes from crime, or for any purpose other than your own trading.
13.2 If we reasonably believe you have breached section 13.1, we may do one or more of the following: restrict or suspend your accounts, hold deposits and withdrawals connected with the breach while we investigate, as the Regulations for Non-Trading Operations allow, and close your accounts under section 16. We will tell you what we have done unless the law prevents us.
14. Communications
14.1 We communicate with you in English, by email to the address you registered and through the client portal and web terminal. Notices we send to your registered email address are treated as received when sent.
14.2 You can contact us at support@ogofx.com. Our support team is available 24 hours a day, Monday to Friday.
14.3 Records of your orders, trades, deposits and withdrawals kept on our systems are evidence of what took place. You should check your account history regularly and tell us at once if anything looks wrong.
15. Personal data and confidentiality
15.1 We collect and use your personal data to open and run your accounts, to verify your identity, to meet our legal obligations and to keep our services secure, as described in our Privacy Policy.
15.2 We keep your information confidential. We disclose it only as our Privacy Policy describes, including to our liquidity provider and service providers so far as they need it to provide our services, and where the law requires us to.
16. Suspension and termination
16.1 By you. You may end this Agreement, or close a trading account, at any time by writing to support@ogofx.com. Before closing, you should close your open positions and withdraw your free funds.
16.2 By us. We may end this Agreement or close any of your accounts by giving you notice by email. We may do so with immediate effect, and may suspend access to your accounts in the meantime, if:
- you breach this Agreement, including section 13;
- information you gave us is false or you do not give us information we have asked for under section 4;
- we are required to by law, by an authority or by our liquidity provider; or
- we reasonably suspect fraud, unauthorised access to your account or unlawful activity.
16.3 Effect. When an account is closed, we may close any open positions on it at the prices then available. After deducting any amounts you owe us under this Agreement, we pay the remaining balance to a USDT (BEP20) address you give us, subject to section 11 and to the completion of verification.
16.4 Ending this Agreement does not affect trades already made, rights and obligations already arising, or sections 12, 13, 17 and 18, which continue to apply.
17. Liability
17.1 Trading CFDs carries a high risk of loss. You accept that losses from your trading decisions, from market movements, from slippage, from gaps and from the operation of stop-outs are yours.
17.2 We are not liable for any loss caused by:
- events beyond our reasonable control, including market disruption, suspension of trading in an underlying market, failure of the liquidity provider, network or internet failure, failure of BNB Smart Chain, and acts of government;
- delays, interruptions or unavailability of the web terminal, the client portal or a price feed, so far as not caused by our negligence;
- your equipment, internet connection or browser, or anyone else's use of your login details;
- acting on instructions given through your login, or on information you gave us;
- transfers made to a wrong address, token or network.
17.3 We are not liable for any loss of profit, loss of opportunity or indirect or consequential loss.
17.4 Nothing in this Agreement limits liability that cannot be limited by law, including liability for fraud.
17.5 Indemnity. You will compensate us for any loss we suffer as a result of your breach of this Agreement or of the law.
18. Complaints
18.1 If you are unhappy with our service, including the handling of a trade, email support@ogofx.com with the word “Complaint” in the subject line, and give your registered email address, the account number, what happened and the outcome you want. For a trade, include the order or position number and the time of the event in broker server time.
18.2 We review your complaint, including the records described in section 14.3, and give you our answer in writing by email.
19. Changes to this Agreement and to trading terms
19.1 OGOFX may change the Client Agreement and the Terms of Business. A change is made by publishing a new version of the document on its page on ogofx.com with a new effective date, and it takes effect on that date. Figures that the platform holds, including spreads, swap rates, commission, markups, leverage limits, margin call and stop-out levels, lot limits, minimum deposits, the instruments offered and their trading hours, can change at any time; the figures that apply to an order or a request are those shown in the web terminal and the client portal at that moment. If you do not accept a change, you may close your trading accounts and end the Client Agreement under section 16.1 of the Client Agreement. If you keep using your account after a change takes effect, you accept it.
